Does the SwampBike supply food or beverages?
No. Riders may bring on any permissible food or beverages they wish. We’ve got LOTS of space in the inside roof rack. Alcohol is NOT permitted on the SwampBike there will be several stops at various pubs and restaurants during your tour.
Can I tip my driver?
Yes. The driver would greatly appreciate your generosity.
How many people ride on SwampBike? How many pedal?
Each SwampBike carries 15 passengers. There are 6 pedaling seats on each side, and one non-pedaling seat over the rear wheels that seats 3 passengers.
What if it is cold, rainy or windy the day of the SwampBike tour?
The SwampBike operates rain or shine. We’re in Florida-we can dress for the weather! If severe weather does occur, then the SwampBikeer reserves the right to cancel the tour and offer all renters a rain check. We also offer a rain check if the tour has to be canceled due to weather within the first hour of the tour!
What if our Swamp Bike tour takes too long?
You may be charged a late fee if you do not return the bike to its starting point within 15 minutes of the scheduled return time. (Traffic beyond our control is taken into consideration!) The time it takes to complete a tour is up to the people pedaling, as the driver doesn’t pedal. We have test-pedaled all routes in order to inform our riders of the tour lengths!
Do you provide a driver on the SwampBike?
Always. Our insurance provider requires it.
Who can’t ride the SwampBike?
The SwampBike has a minimum height requirement of 5’3” or greater for pedaling seats; however, we do have 12 adjustable seats. Additionally, there is a maximum weight limit of 300 pounds for each person on the bike seats. The back seat is perfect for those who don’t exist within the height and weight limitations! All riders must be 18 years or older and provide a valid identification.
Who’s in charge of the SwampBike?
- The driver. If you act in a dangerous manner, you’ll be asked to get off and find your way home. You can imagine the difficulty we had finding insurance for this thing in America. It’s mandatory that we keep it!
- The renter. Only one person can be the renter and that person is the only person the driver answers to. Can you imagine 15 people arguing about when to leave a location. We don’t want our drivers getting in the middle of that!
What’s the waiver for? And what about the offer of the helmets for the pub crawl?
Riding the SwampBike can be a dangerous activity, just like riding a bike. You should have a reasonable expectation that you could possibly fall off and scrape your knee. We offer bike helmets because, it’s prudent. You don’t have to wear one-that’s totally up to you. But, you take responsibility if you bump your noggin’.
RELEASE OF LIABILITY I understand that operating the SwampBike is a potentially dangerous activity. I assume the risk that I may be injured and/or injure someone while using the SwampBike. I assume all risks associated with the use of the SwampBike and will not bring any action against the Cold Green, LLC its successors and or assigns for personal injury, property loss, or property damage, including any action for negligence, breach of warranty, products liability or strict liability.
The SwampBike is of proprietary manufacture, and I agree not to build or cause to be built any vehicle of same or similar construction.
I further agree to release, indemnify and hold harmless the owners and manufactures of the SwampBike from any liability against any and all claims, including damages and demands of third parties as a result of my use of the SwampBike.
RULES AND REGULATIONS No portion of this may be omitted, or changed in any way. The SwampBike is proprietary manufacture, and I agree not to build or cause to build or cause to be built any vehicle of the same or similar construction. I grant SwampBike permission in the perpetuity to use photos or video of me for promotional purposes including but, not limited to, use on social media sites. All participates on our public tours must be 18 years old or older. No glass or Alcohol of any kind is allowed on the SwampBike. The SwampBike driver is responsible for the tour and his or her decisions are final. Inappropriate behavior before, during and after the tour will result in the offending in the offending passenger(s) being asked to disembark the SwampBike. Such behavior includes but, is not limited to: flashing/mooning, fire drills, extreme intoxication, illegal drug use, littering including dumping trash, public urination, loitering more than five minutes after the tour, returning late and excessive noise or profanity. No weapons of any kind are permitted on the SwampBike Tours. Severe transgressions, including but not limited to those described above will result in the SwampBike tour ending immediately and/or causing a late damage/towing fees of up to $500 to be charged to the renter’s credit card. If a ticket or fine is issued by a municipally because of behavior of the group, or member of the group, that cost will be charged to the renter’s credit card. Late fees will be charged if we do not return to our office on time. A cleaning fee up to $100 may be applied if excessive before, during and after the SwampBike Tour. Any person arriving in an intoxicated condition shall not be allowed on the SwampBike.
PARTIES RELEASED PARTIES include Cold Green, LLC and its directors, officers, agents, contractors, insurers, spectators, equipment suppliers, and volunteers, event sponsors, organizers, promoters, directors, officials, property owners, and advertisers, governmental bodies and/or municipal agencies whose property and/or personnel are used and any or all parent, subsidiary or affiliate companies, licensees, officers, directors, partners, board members, supervisors, insurers, agents, equipment suppliers, and representatives of any of the foregoing.
RELEASING PARTIES include the participant as well as the participant’s spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns or anyone else who might claim or sue upon participant’s behalf.
ASSUMPTION OF INHERENT RISKS Cold Green, LLC tour (which, as used herein, includes all aspects of the Cold Green, LLC experience such as boarding the SwampBike, riding the SwampBike, pedaling the SwampBike, and disembarking from the SwampBike) and involves inherent risks that cannot be eliminated completely regardless of the care and precautions taken by SwampBike. I understand and acknowledge that the inherent risks include, but are not limited to: 1) contact or collision with persons or objects, contact with other participants, contact or collision with motor vehicles or machinery including the SwampBike; 2) encounter with obstacles such as road and surface hazards; 3) equipment related hazards such as defective or inadequate equipment or equipment that unexpectedly fails; 4) weather-related hazards such as extreme heat, extreme cold, humidity, ice, rain, fog, and lightning; 5) inadequate first aid and/or safety measures; 6) judgment and/or behavior related problems of co-participants, the participant, or personnel working for SwampBike; and, 7) natural hazards such as uneven terrain, falling objects, contact with wildlife or poisonous plants. I further understand and acknowledge that any of these risks and others, not specifically named, may cause injury or injuries that may be categorized as minor, serious, or catastrophic. Minor injuries are common and include, but are not limited to: scrapes, bruises, sprains, nauseam and cuts. Serious injuries are less common, but may sometimes occur. They include, but are not limited to: property loss or damage, broken bones, torn ligaments, concussions, exposure, heat-related illness, mental stress, and exhaustion. Catastrophic injuries are rare; however, we feel that our participants should be aware of the possibility. These injuries can include permanent disabilities, spinal injuries and paralysis, stroke, heart attack, and even death. I also understand that it is my responsibility to consult with my personal physician prior to participating on the tour to ensure that such participation will not pose unusual risks to my health and well-being. I UNDERSTAND FULLY THE INHERENT RISKS INVOLVED IN THE TOUR AND ASSERT THAT I AM WILLINGLY AND VOLUNTARILY PARTICIPATING IN THE TOUR.
I have read the preceding paragraphs and acknowledge that: 1) I know the nature of the SwampBike tour; 2) I understand the demands of this activity relative to my physical condition; and, 3) I appreciate the potential impact of the types of injuries that may result from the tour. I HEREBY ASSERT THAT I KNOWINGLY ASSUME ALL OF THE INHERENT RISKS OF THE ACTIVITY AND TAKE FULL RESPONSIBILITY FOR ANY AND ALL DAMAGES, LIABILITIES, LOSSES, OR EXPENSES THAT I INCUR AS A RESULT OF PARTICIPATING IN THE TOUR.
WAIVER OF LIABILITY FOR ORDINARY NEGLIGENCE. In consideration for being permitted to participate in the tour, I (ON BEHALF OF THE RELEASING PARTIES) HEREBY FOREVER WAIVE, RELEASE, COVENANT NOT TO SUE, AND DISCHARGE Cold Green, LLC AND THE OTHER RELEASED PARTIES FROM ANY AND ALL CLAIMS RESULTING FROM THE INHERENT RISKS OF THE TOUR OR THE ORDINARY NEGLIGENCE, IMPLIED OR OTHERWISE, OF Cold Green, LLC (OR OTHER RELEASED PARTIES) THAT I MAY HAVE ARISING OUT OF MY PARTICIPATION IN THE TOUR.
This waiver does not cover willful or negligence. This agreement applies to: 1) personal injury (including death) from incidents or illnesses arising from participation in the tour; and, 2) any and all claims resulting from damage to, loss of, or theft of property.
INDEMNIFICATION AGREEMENT. In consideration of being permitted to participate in the tour and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby agree to hold harmless, defend, and indemnify Cold Green, LLC (and other Released Parties) from and against: 1) any and all claims made by me (or any Releasing Party) arising from injury or loss due to my participation in the tour; and, 2) against any and all claims of co-participants, rescuers, and others arising from my conduct in the course of my participation in the tour. For the purposes hereof, claims include all actions and causes of action, claims, losses, costs, expenses, and damages, including legal fees and related expenses. This indemnity shall survive the expiration or sooner termination of the tour. SwampBike shall have the right to select its counsel in the event that you are obligated to defend SwampBike under this agreement.
VENUE AND JURISDICTION. I understand that if legal action is brought, the appropriate state or federal trial court has the sole and exclusive jurisdiction and that only the substantive laws shall apply.
SEVERABILITY. I understand and agree that this agreement is intended to be as broad and inclusive as is permitted and that if any provision shall be found to be unlawful, void, or for any reason unenforceable, then the provision shall amend to be lawful and enforceable to the broadest and most inclusive extent possible. If it cannot be amended and remain lawful the provisions shall be severed from this agreement and does not affect the validity and enforceability of any remaining provisions.
INTEGRATION. I affirm that this agreement supersedes and all previous oral or written promises or agreements regarding the subject matter set forth herein. I understand that this is the entire agreement between me and SwampBike regarding the subject matter set forth herein and cannot be changed or modified in anyway by representations or statements by any agent or employee of SwampBike.
MEDIATION AND ARBITRATION. In the event of a dispute over this agreement, I agree to engage in good faith efforts to mediate any dispute that might arise. Any agreement reached will be formalized by a written contractual agreement at that time. Should the issue not be resolved by mediation, I agree that all disputes, controversies, or claims arising out of my participation in the tour shall exclusively by submitted to binding arbitration in accordance with the applicable rules of the American Arbitration Association in effect. The cost of such action shall be shared equally by the parties.
ACKNOWLEDGEMENT OF UNDERSTANDING. I have read this agreement and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I further acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be complete and unconditional release of all liability due to ORDINARY NEGLIGENCE of Cold Green, LLC (and other Released Parties) or the INHERENT RISKS of the activity, to the greatest extent allowed by law. I understand that this agreement applies to all future uses of the SwampBike.
Any violations of the tour behavior rules may result in ride termination for the Individual, or entire group. Some, but not all are listed below.
- Standing While Moving
- Fire Drills
- High Fiving Pedestrians
- Use of Alcohol
- Jumping on pedals
- Loud Profanity
- Extreme Intoxication
- Public Urination
The following will result in additional charges to the primary renter’s or induvial credit card.
- Returning late (10 min =$55, 20 min=$70, 25 min=$85 and 30 min= $200 and $250 minimum more than an hour late
- Excessive Cleaning ($100)
- Abandoning the bike or Refusing to pedal ($200)
- Damage to the bike (cost of repairs)
When do I pay for the Swamp Bike? How do I pay?
The renter pays when the tour is booked, regardless of how far in advance. A tour is reserved once we have received payment, and you have received a confirmation from us. You can pay by Visa, Mastercard, American Express, Discover. If you prefer to pay 50% deposit, with the balance due the week prior, please call us at 1888.600.2077.
What if I want to cancel or reschedule my SwampBike?
If for some reason you really need to cancel (we can’t imagine why!), the renter has the choice of receiving a 50% refund or a rain check valid 3 months, if the cancellation is 30 or more days prior to the tour date. Cancellations between 29-14 days will receive a rain check valid for 3 months only. Cancellations less than 14 days will receive no rain check or refund.
Does the SwampBike run all year long?
What’s the earliest/latest I can rent the SwampBike?
Hours of operation are generally between 1pm – 9pm.
What’s the minimum number of people required to operate the SwampBike?
While it’s ideal to have at least 10 people in your private group, for smaller groups, please check out our SocialSuds.
Hey, how fast is that thing?
On the flat, SwampBike travels at maximum speed of approximately ten miles per hours.
